DHS Subpoenas Two Journalists Who Published Leaked Airline Security Changes

The Department of Homeland Security, which oversees the Transportation Security Administration, sent federal agents to the homes of two journalists and served them with subpoenas on Tuesday night to try to identify the source of a leak about aviation security changes imposed after the failed attempt on Christmas Day to blow up Northwest Flight 253.

In separate visits, the DHS employees told Chris Elliott and Steve Frischling that their computers and all e-mail correspondence related to the leak of the security directive were being subpoenaed as part of an investigation into who leaked the document to them, which both journalists published on their Web sites.

The directive, issued within hours after 23-year-old Umar Farouk Abdulmutallab failed to detonate explosives that had been sewn into his underwear, restricted passenger movement and activities on all international flights. After being published by Elliott and Frischling, the restrictions were widely ridiculed by travel experts, bloggers, and news organizations, which deeply embarrassed the TSA and the homeland security agency, already under pressure for their missteps in the foiled attack.

The TSA backtracked almost immediately on the restrictions -- which had ordered airlines, among other things, not to permit passengers to go to the bathroom an hour before arrival on all international flights and to prevent them from holding pillows, blankets and personal possessions on their laps. A TSA spokesman said that the added security precautions were discretionary.

Elliott, the blogger who first published Security Directive SD-1544-09-06 and writes a travel column for The Washington Post, said he was surprised and somewhat intimidated by the TSA visit and being served with the subpoena. In his blog, Elliott wrote that he had "just put the kids in the bathtub when Special Agent Robert Flaherty knocked on my front door with a subpoena. He was very polite, and used "sir" a lot, and he said he just wanted a name: Who sent me the security directive?"

CIA Prepared Report on Nigerian Terror Suspect Before Attempted Attack, Sources Say

Elliott said in an interview that he had declined to tell Flaherty the identity of his source or turn over his computer. He said he has referred further inquiries about his stance to Mark Holsher, an attorney, who did not return calls for comment.

Frischling, who runs a travel Web site called "Flying with Fish" and published the directive minutes after Elliott, said in an interview today that he had given his computer to the two federal agents who came to his house on Tuesday night. Frischling said he complied with their request after they asserted that he was "not a journalist" and handed him a subpoena, telling him he had now been "served." They also said they would return the next morning to confiscate his computer and other communications equipment if he failed to cooperate.

Frischling said his computer was returned this morning with several corrupted sectors and that he was running software to repair it. He said he had given the agents his computer because the directive had been sent to him anonymously, that he had deleted the original e-mails, and that it had been sent to him by someone who had undoubtedly used a phony e-mail name and address.

Francis DiScala Jr., Fischling's attorney, criticized the DHS for using "heavy-handed tactics" and "intimidating" his client. "Federal agents came and confiscated the tools of his trade at night in front of his three children," DiScala said. "When federal agents show up at your door with badges, their very presence is intimidating. The weight of the government is on you and just you. Steve was not motivated by generosity in giving up his personal computer, which he uses to earn a living."

Frischling said that the subpoena he received Tuesday, which was first reported by the Daily Kos, was almost identical to that posted by Elliott on his Web site. That subpoena, issued by the administrator of the TSA and the Department of Homeland Security, orders him to "produce and permit inspection and copying of the records" related to the inquiry to Special Agent Flaherty "no later than COB (close of business) December 31, 2009, in furtherance of an official investigation." The subpoenas order the recipients to produce "all documents, e-mails, and/or faxsimile transmissions in your control possession or control" regarding the "receipt of TSA Security Directive 1544-09, dated December 25, 2009."

The subpoena also warns that failure to comply makes the recipient "subject to fines" and "imprisonment for not more than one year," or "both."

Flaherty, who is based in a TSA office in Orlando, Florida, did not return e-mails asking him for comment on his investigation, or why he and other agents went to the journalists' homes at night.

Spokesmen for the Department of Homeland Security declined comment on the inquiry and subpoenas. The TSA, which never posted its regulations which are set to expire after Dec. 30, confirmed the existence of a leak investigation. Its statement asserted that security directives were "not for public disclosure" and that the TSA's Office of Inspections was "currently investigating how the recent SDs were acquired and published by parties who should not have been privy to this information."

Both the TSA and its parent Department of Homeland Security have been heavily criticized not only for the temporary security restrictions but for their handling of the terrorist incident more broadly. The transportation agency has been lambasted, for instance, for having allowed Abdulmutallab to board the Detroit-bound flight that originated in Nigeria with virtually no luggage and having bought a round-trip ticket in cash. DHS Secretary Janet Napolitano has also faced heat for having initially asserted in talk shows Sunday that the aviation security system worked well because the attack was foiled and other planes in the air were informed of the incident soon after the foiled attack took place.

Stung by the criticism, Napolitano reversed course on Monday, saying her remarks had been taken out of context, and that the incident had raised troubling security concerns. On Tuesday, three days after the incident, President Obama emerged from his vacation seclusion in Hawaii to deliver a broadside attack on the handling of the incident, saying it reflected a "systemic failure" that he considered "totally unacceptable." He has ordered a review of the incident, which he called a "catastrophe." A preliminary copy of that review is supposed to be delivered to him Thursday.

That the TSA would spend time and resources pursuing journalists about the origins of the leak of its security directive rather than focusing on finding how Abdulmutallab was able to board the plane despite intelligence indicating he was a potential security risk says much about the agency's priorities.

Elliott said he did not regret having published the directive, since he was a "consumer advocate trying to help the flying public." The TSA's security restrictions following the failed attack, he said, were "poorly thought through and didn't match up with what the TSA was telling the airlines." No one knew what was going on, he said "because the TSA did not respond" to his questions. He published it, he added, because the document did not state that it was secret or classified. "And that's what led to the knock on my door."

Lucy Dalglish, who heads the Reporters Committee for Freedom of the Press, a non-profit group which defends reporters and news organizations fighting for freedom of expression, said that the subpoenas "border on the ridiculous."

"Certainly TSA is enraged that it's order not to release this information was violated. Yet, there's nothing national security-related in the directive posted by Chris Elliott," she said.

She said it pertains more to what travelers already know: "Carry-on luggage is being searched and folks are being frisked at the gate."

A case of inconvenient truth that the EPA did not want released at an inconvenient time - the day before the House was to vote on a controversial energy bill destined to be the largest tax hike in American history:

[...] Alan Carlin, the senior EPA research analyst who authored a study critical of global warming that was suppressed by agency officials, has broken his silence and spoken on Fox News about his situation. Carlin told "Fox & Friends" Steve Ducy and Gretchen Carlson that his most important conclusion in the study was that the U.S. should not rely upon recommendations of the UN in making policy decisions regarding global warming.

"The most important conclusion, in my view, was that EPA needed to look at the science behind global warming and not depend upon reports issued by the United Nations, which is what they were thinking of doing and in fact have done," Carlin said.

Asked what happened to his study once it was completed, Carlin said "my supervisors decided not to forward it to the group within EPA who had the responsibility for preparing an overall report which would guide EPA on whether to find that the emission of global warming gases would be something that EPA should regulate."

... Carlin has been at EPA for 38 years and until the Fox interview was telling reporters seeking interviews that he was instructed by EPA officials not to speak with them. He almost certainly risks retalitation by EPA Administrator Lisa Jackson and other Obama appointees within the agency.

The Illustrated Results of Obama's "Community Organizing"...Obama Was Not Even A Decent Community Organizer




If I didn't know better, I'd think this was Beirut in the nineteen seventies. But, in reality, it's the current state of the housing for which Barack Obama claims responsibility as a "community organizer." It turns out the developers enriched by his government-funded subsidies did a heck of a lot better than the folks who once lived here.


I say "once", because the Boston Globe ("Grim Proving Ground for Obama's Housing Policy") calls many of the units "uninhabitable".

As a state senator, the presumptive Democratic presidential nominee coauthored an Illinois law creating a new pool of tax credits for developers. As a US senator, he pressed for increased federal subsidies. And as a presidential candidate, he has campaigned on a promise to create an Affordable Housing Trust Fund that could give developers an estimated $500 million a year.


But a Globe review found that thousands of apartments across Chicago that had been built with local, state, and federal subsidies - including several hundred in Obama's former district - deteriorated so completely that they were no longer habitable.


Grove Parc and several other prominent failures were developed and managed by Obama’s close friends and political supporters. Those people profited from the subsidies even as many of Obama’s constituents suffered. Tenants lost their homes; surrounding neighborhoods were blighted.

In terms of concrete accomplishments, Obama and “hundreds of other organizers” were not able to transform the South Side neighborhoods or bring in new industries to provide jobs...


Obama’s most commonly cited achievement was in forcing the city to begin testing for asbestos in all city apartments.

...critics claim Obama, now 46, exaggerates his accomplishments, particularly in spearheading asbestos cleanup at a low-income housing project. He omits from his account of that fight a longtime community activist who many people say played a significant role.


And for all his emphasis on the value of grassroots organizing, Obama eventually decided he also needed a law degree to enact lasting change, attending Harvard University... Further blurring the picture are his descriptions of community organizing in his youthful memoir, "Dreams From My Father," in which he admits he disguises names, creates composite characters, switches some chronologies and uses "approximations" of dialogue.

I can see why.


Look at this beautiful playground, with all of children frolicking; they're so care-free and so delighted that Barack Obama's community-organizing has helped them at the expense of his developer friends.

The squat brick buildings of Grove Parc Plaza, in a dense neighborhood that Barack Obama represented for eight years as a state senator, hold 504 apartments subsidized by the federal government for people who can't afford to live anywhere else.


But it's not safe to live here.



About 99 of the units are vacant, many rendered uninhabitable by unfixed problems, such as collapsed roofs and fire damage. Mice scamper through the halls. Battered mailboxes hang open. Sewage backs up into kitchen sinks. In 2006, federal inspectors graded the condition of the complex an 11 on a 100-point scale - a score so bad the buildings now face demolition.

As a community organizer, Obama's a hell of a public speaker.

The poor people living here have gotten the shaft from Obama and his developer buddies. And the mainstream media couldn't care less.

Drenched In Blood Of Slavery..You Guessed It..The Democratic Party Is Where It All Started



The U.S. Senate voted unanimously last week to adopt a resolution apologizing for slavery.

Sen. Tom Harkin, D-Iowa, lead sponsor of the resolution, said, "You wonder why we didn't do it 100 years ago. It is important to have a collective response to a collective injustice."

Only after decades of public education
ignoring and distorting U.S. history can such a huge lie be said with a straight face.

Senator, you didn't do it 100 years ago because 100 years ago you Democrats were enforcing Jim Crow segregation laws, poll taxes to keep blacks from voting, and riding around in sheets and pointy hats just in case blacks didn't get the message.

You say "It's important to have a collective response" because you want to bury the origins, purposes, and historical practices of your own party.

The worst part is, Republicans in the Senate let you get away with it.

Principled Republicans knowing their history would have authored a resolution reciting the facts that the Republican Party was formed, among other reasons, to oppose slavery and that the Republican Party and its first President Abraham Lincoln responded to Southern, Democrat-led secession with a successful war that preserved the union and freed the slaves.

After Lincoln's assassination (by a Democrat), the Republican-led Congress (over the objections of the Democratic Party minority) amended the Constitution to confirm the liberation of the slaves (13th Amendment: slavery abolished), and the 14th Amendment (freed slaves are citizens equal to all citizens) and the 15th Amendment (right to vote guaranteed to freed slaves).

Southern Democrats spent the next 100 years trying to keep freed slaves down with segregation laws, poll taxes to deny the right to vote, and lynching to enforce the social order. The KKK was formed by a Democrat; no Republican has ever been a member of the KKK. This is the heritage of the Democratic Party.

In fact, the Democratic Party was formed in the first place to defend and expand slavery.

In 1840, the very first national nominating convention of the Democratic Party adopted a platform which read in part:

Resolved, That Congress has no power ... to interfere with or control the domestic institutions of the several states ... that all efforts by abolitionists ... made to induce Congress to interfere with questions of slavery ... are calculated ... to diminish the happiness of the people, and endanger the stability and permanency of the union.

Got that, Sen. Harkin? Your party was born defending slavery as necessary for the happiness of the people and threatening secession and war if slavery were challenged.

The same party platform language was used in 1844, 1848, 1852 and 1856. In 1860, the Democrat commitment to slavery took a harsher tone.

The Fugitive Slave Law was passed by Congress in 1850. This monstrous law provided that, since slaves were the personal property of their masters, runaway slaves must be returned to their owners. The law required all law enforcement officers to assist in the recapture of runaway slaves or risk a fine of $1,000 (about $100,000 in today's dollars)!

The Republican Party was formed in the 1850s in part as a political reaction to this unjust law.

In their national convention of 1860, Democrats harshly responded to certain Northern (Republican) states that were passing state laws to evade the Fugitive Slave Law by adopting a plank in the Democratic Party Platform which read:

Resolved, That the enactments of the State Legislatures to defeat the faithful execution of the Fugitive Slave Law, are hostile in character, subversive of the Constitution, and revolutionary in their effect.

Senator, your Democratic Party has much to be apologetic about on the slavery issue.

During the civil war, the Southern Democrats led the Confederacy out of the Union; Northern Democrats formed a separate party which opposed the war. The 1864 (Northern) Democratic Party platform adopted a "peace" plank which read in part:

... after four years of failure to restore the union by the experiment of war ... justice, humanity, liberty, and the public welfare demand ... a cessation of hostilities ... to the end that ... peace may be restored ...

Here is the origin of today's Democratic Party "Peace at any Price, Better Red than Dead, Why Can't we all just get Along" foreign policy.

The war was started by Democrat secessionists, and just as President Lincoln was on the verge of victory, the Northern Democrats wanted to save the South and slavery with "peace talks"! Voters knew better in 1864 and re-elected Lincoln.

But the Democrats weren't through. In 1868, Sen. Harkin's party condemned the Republican Party in its party platform as the "Radical Party," and condemned Reconstruction in these unforgettable words:

Instead of restoring the Union, it (the Radical Party) has dissolved it, and subjected ten states (the former Confederate states) ... to military despotism and negro supremacy.

And, senator, don't tell me this is all ancient history in a lame attempt to evade the true origins of your party.

As recently as 1964, when the Senate debated the Civil Rights Act, Southern Democrats (including Al Gore's father) voted no. While Northern Democrats voted yes, their votes were not enough. The deciding votes to pass this landmark bill were provided by Sen. Everett Dirksen, R-Ill., and the Republicans.

Republicans should be proud of their heritage of liberation of the slaves and civil rights voting record.

It's Harkin and the Democrats who should apologize and pay reparations.

Late Monday night, Republican National Committee Chief of Staff Ken McKay fired off a complaint to the head of ABCNEWS:

Dear Mr. Westin:

As the national debate on health care reform intensifies, I am deeply concerned and disappointed with ABC's astonishing decision to exclude opposing voices on this critical issue on June 24, 2009. Next Wednesday, ABC News will air a primetime health care reform “town hall” at the White House with President Barack Obama. In addition, according to an ABC News report, GOOD MORNING AMERICA, WORLD NEWS, NIGHTLINE and ABC’s web news “will all feature special programming on the president’s health care agenda.” This does not include the promotion, over the next 9 days, the president’s health care agenda will receive on ABC News programming.

Today, the Republican National Committee requested an opportunity to add our Party's views to those of the President's to ensure that all sides of the health care reform debate are presented. Our request was rejected. I believe that the President should have the ability to speak directly to the America people. However, I find it outrageous that ABC would prohibit our Party's opposing thoughts and ideas from this national debate, which affects millions of ABC viewers.

In the absence of opposition, I am concerned this event will become a glorified infomercial to promote the Democrat agenda. If that is the case, this primetime infomercial should be paid for out of the DNC coffers. President Obama does not hold a monopoly on health care reform ideas or on free airtime. The President has stated time and time again that he wants a bipartisan debate. Therefore, the Republican Party should be included in this primetime event, or the DNC should pay for your airtime.

It seems like decades ago that the greatest nation of earth began a mind-boggling experiment in liberal guilt abatement called Obamamania.

That phenomenon essentially turned the mantle of federal power over to a young, handsome and charismatic, but tragically unqualified, black man from the streets of Chicago.

Just five months ago, the Windy City turned itself upside down in celebrating the coronation-deification of Barack Obama whose formula for CHANGE would, we were promised, fix all of the messes left by his predecessor, the unlovable George W. Bush, and all who preceded W. in mismanaging the government from the Oval Office.

From the depressed economy to the war on terror, the wars in Iraq and Afghanistan, the Israeli-Palestinian conflict, the health care crisis, failing automobile industry, illegal immigration disaster, to America’s battered image among Mullahs and communist dictators all across the globe, this Obama fellow was the answer.

So we were told.

As it turns out, Barack Obama has gone from the pinnacle of adoration and glory to being the object of lusty boos in just five short months.

Moreover, in his hometown while speaking from the presidential lectern to boot!

“For all the young president’s popularity, the response he got Monday from doctors at an American Medical Association meeting was a sign his road is only going to get rockier as he tries to sell his plan to overhaul the nation’s health care system.

“The boos erupted when Obama told the doctors in Chicago he wouldn’t try to help them win their top legislative priority—limits on jury damages in medical malpractice cases.

“But what could they expect? If Obama announced support for malpractice limits, that would set trial lawyers and unions—major supporters of Democratic candidates—on the attack. Not to mention consumer groups.”

Still, there IS hope: Mid-term elections are but 17 months away, at which time the American people can isolate the Obamamania pandemic by removing many of his left wing co-conspirators from the US Congress!

Challenge to FOX NEWS! Report on Facts NOT Emotions

Here is somethings that are not matching the issues.

Everyone on Fox is so strongly out to attack anyone who is seeking the birth certificate.
Labeling all of who are demanding for FACTs to be disclosed on Obama and his proof he is legally entited to hold the office of Commander In Cheif according to the US Constitution...
The Fox News is labeling anyone who has being such as a VERY SMall Group of Extremists.
It is carefully placing a mirror to anyone who holds these veiws as someone who is also a "Nut Case"
That We are not entitled to hold a true concern on what impacts the current paths of Obama has taken us down to socialisim.
Fox News is also going on with the statments that lable anyone who has these ideals and are claiming now that DHS Was right by their actions without a thorough investigation into the background of the indivudial who done the acts in the Holocaust Museum.

Fox News has also labeled anyone who opposes Obama and the issues related to thge constitutional facts he is not entitled to hold the position of President and Commander in Cheif as Hating Jews and Racists!!!

If Fox News wants to go into facts I challenge FACTS.
I challenge them to begin reporting on news that was given to thiem from a woman in Israel when a File Cabinet was sold to her by the US Consulate with records of US Tax Dollars being given to the Terrorist Group Fatah youth Group.
I also challenge them to be more concise and accurate in their actual reporting when it comes to reporting facts that I know I have personally sent to Hannity and Beck as well as Col Oliver North.
If they want to report facts? Then Do it!!!
Do not hide behind a shadow of fear.
When the "Pandemic" Was an issue I showed Fox News this was a Hoax.
From Doctors! even Dr Ron Paul!!! and yet it was not reported!!!

This is not fair reporting!
It also proves a very powerful statement.
There is no truth in the News and No News in the Truth!!
I am a bit skeptical on this act of violence. I will not say that it was Government intervention into stir up a panic. But I will not refuse this as being possible.
Was it something that was a lone man? or was it something that was spured on by any government agency. US Or otherwise.
Where did he get the Ammunition ?
Where did he get the weapon?
Yet more important who is this guy?
For one Fox News already reported that he was not just any World War II Veteran. He was the Commander of a PT Boat.
This means that he was an commissioned officer during WWII.
This also suggests that he has been involved in OSS which years later became the CIA.
He is been reported as having a criminal record of going into the Federal Reserve with a weapon back in the 1950;s This was during the same time frame as when Paul Volcker was part of the Federal Reserve (1953) in NY.
It is also important to look at not just the accused background it is important to look at all the details of this matter!
This is nothing more then a smoking gun into what the Federal Government wants to do if you disagree with actions they are taking and are not part of the two party system Maybe?
My heart and prayers go out to these whom where injured. Although I am not going to sit and state that this was not something that was a clandestine operation to escalate a more dubious action that the Federal Government wants to do to control the people. Even a tactic that would be argued to seize firearms.

Here is something to look at as well.
The Man that is accused attacked a Jewish Museum. This would resemble being a possible Pro Palestine movement. If you are not for the Jews you are against them. If you are a Christian. A truely bible knowledged Christian you know that Jews are the Children of God. and you also understand that the True Jewish Sect is not the enemy it is the Government which attempts to supress and create a clandestine Unrest among peoople that is the enemy.
When you listen to the News you here all the praise of Obama visiting the Concentration Camp.
What you haven't seen though was his actual interest in this issue!
By this I mean: He didn't take his Great Uncle on the trip. He didn't even provide him a means to go As I showed in the reported interview.

The Obama PAYGO Farce...And Folks This Is A Farce If There Ever Was One.



Did you ever know anyone that would repeatedly go out to the bar, drink themselves unconscious, and then wake up the next morning and promise never to drink again? That is President Barack Obama when it comes to spending. This February, after signing the largest single-year increase in domestic federal spending since World War II, President Obama held a “fiscal responsibility” summit designed to “send a signal that we are serious” at putting the nation on sounder financial footing. The Washington Post’s Dana Milbank quipped at the time: “Holding a ‘fiscal responsibility summit’ at the White House in the middle of a government spending spree is a bit like having an Alcoholics Anonymous meeting at a frat house on homecoming weekend.”

Obama completed the exact same kabuki act yesterday, calling on Congress to pass “pay-as-you-go” legislation (PAYGO) the day after he promised faster deficit spending to stimulate the economy. Commenting on President Obama’s exemption for entitlement spending in his PAYGO legislation, Committee for a Responsible Federal Budget President Maya MacGuineas said: “This is like quitting drinking, but making an exception for beer and hard liquor.”

In theory, PAYGO sounds like common sense: Congress can only spend a dollar if it saves a dollar elsewhere. In reality, PAYGO is nothing more than a political gimmick that only enables higher spending and exploding deficits. Heritage fellow Brian Riedl explains:

1) PAYGO has never been enforced

* During the 1991-2002 round of statutory PAYGO, Congress and the President still added more than $700 billion to the budget deficit and simply cancelled every single sequestration that would have enforced PAYGO.
* Since the 2007 creation of the PAYGO rule, Congress has waived it numerous times in order to add $600 billion to the deficit. In fact, the entire “stimulus” bill violated PAYGO; Congress simply ignored the rule.

2) PAYGO’s design is flawed

* PAYGO exempts all discretionary spending, and would also allow all current entitlement programs like Social Security, Medicare, and Medicaid to continue growing on autopilot. It affects only new entitlements or tax cuts that may be created in the future.
* Even if PAYGO were fully enforced, entitlement spending would still grow 6 percent annually, and discretionary spending could grow without limit.

Already this year Obama expanded Medicaid liabilities by $200 billion over 10 years, and he is now pushing a public health insurance option that would cost $452 billion per year, or more than $6 trillion over a 10-year period. How does Obama plan to pay for all this new spending under his new PAYGO legislation? He doesn’t. The AP reports: “It would carve out about $2.5 trillion worth of exemptions for Obama’s priorities over the next decade. His health care reform plan also would get a green light to run big deficits in its early years.” So if President Obama does get his trillion dollar health care plan passed, you can count on another “fiscal responsibility summit” soon thereafter.

FBI Wants to Know If Ohio Mosque Has Link to Terror

Nuradin Abdi was convicted in 2007 of planning to blow up an Ohio shopping mall.
A suspect is in custody amid reports of homegrown terrorism.

Iyman Faris was convicted in 2003 of planning to blow up the Brooklyn Bridge.

Christopher Paul was convicted in 2008 of conspiring to use explosives against targets in the U.S. and Europe.

All three terrorists worshiped and socialized at a small mosque in Columbus, Ohio, and, according to David B. Smith, an attorney for Faris, were part of a larger group of jihadists and extremists who frequented the mosque.

The FBI now is investigating reports of links to that same mosque by Muslim-convert Abdulhakim Muhammad who allegedly shot and killed one soldier Monday and critically wounded another in a drive-by attack on a Little Rock, Ark., recruiting station, ABC News has learned.

According to law enforcement sources, they have received reports that Muhammad appears to have attended the mosque during a period from 2006 to 2007 when evidence indicates he resided in Columbus. It is unclear what, if any, links he had to the individuals already convicted.

However, his possible links to the mosque are one promising avenue under investigation as the government attempts to reconstruct Muhammad's path to radicalization and to establish firmly whether he acted alone in the recruiting station shooting.

The mosque, according to well informed sources, is a small house of worship that has regularly been frequented by foreigners with radical sympathies who, after their stops in Ohio, continued onward. The Imam of the mosque was not immediately available for comment.

Columbus has been identified as the jumping off point for Somalis residing in the United States, including Somali Americans, to become radicalized and then head overseas to wage jihad.

Muhammad most recently had come to the attention of law enforcement authorities following his arrest in Yemen last year while carrying a forged Somali passport.

Muhammad, 24, was the subject of a preliminary investigation by the FBI's Joint Terrorist Task Force and may have also been the subject of a prior investigation by authorities in Columbus, Ohio.

Muhammad's Travels to Yemen Scrutinized

His travels to Yemen are another promising area of investigation by the FBI and to other intelligence agencies. While in Yemen it is believed that Muhammad attended the Damaj Institute, an Islamic institute attended by a number of radicalized U.S. converts, which was once attended by John Walker Lindh, the "American Taliban" captured in Afghanistan.

It is unknown what role Muhammad's visit to Yemen may have played in his radicalization. His lawyer Jim Hensley told the Associated Press today that Muhammad went to Yemen to teach English to Afghan war refugees, but was jailed over problems with his visa.

Hensley said Muhammad was "tortured" and "radicalized" while in the Yemeni prison.

Prior to his drive-by shooting at the Little Rock recruiting center, Muhammad had used the Google Maps application to investigate recruiting centers in at least five other states, as well as Jewish institutions, a day care center, a post office and a Baptist Church, according to a report issued Tuesday by the Department of Homeland Security, ABC News has learned. Recruiting centers in New York, Atlanta, Louisville and Philadelphia were on a list of possible targets, based on evidence found in Muhammad's home, according to the report.

A not-for-profit group the Secure Community Network, which is known to be reliable when concerned with threats to parts of the U.S. Jewish community, expanded on the government report.

"Muhammad may have considered and conducted research on other targets in addition to the military recruiting center in Little Rock, including military sites, government facilities, as well as Jewish institutions in several cities throughout the United States," SCN, a Jewish Federations of North America initiative, reported. "Law enforcement officials have reported that Muhammad may have researched Jewish entities in Little Rock."

Muhammad, upon his arrest Monday shortly after the fatal shooting, allegedly confessed and told authorities he acted alone, according to court documents. Officials say that the FBI and the CIA are engaged in an intense effort to reconstruct Muhammad's path to extremism, taking apart his life, examining his friendships, educational records, travel within the United States and possible contacts with extremists overseas.

Though police told ABC News that a preliminary investigation indicated that Muhammad acted alone, federal authorities also are trying to determine whether others were involved in any way -- including supplying weapons, lending encouragement or support, and helping to identify a target. Although he allegedly confessed, Muhammad also has pleaded not guilty to the shooting.

Big Labor's Investment in Obama Pays Off

This is one of the unions wanting to control you and your job with government permission.

"We spent a fortune to elect Barack Obama -- $60.7 million to be exact -- and we're proud of it," boasted Andy Stern, president of the Service Employees International Union, to the Las Vegas Sun this week. The behemoth labor organization's leadership is getting its money's worth. Whether rank-and-file workers and ordinary taxpayers are profiting from this ultimate campaign pay-for-play scheme is another matter entirely.

The two-million-member union, which represents both government and private service employees, proudly claimed that its workers "knocked on 1.87 million doors, made 4.4 million phone calls … and sent more than 2.5 million pieces of mail in support of Obama." It dispatched SEIU leaders to seven states in the final weekend before the election to get out the vote for Obama and other Democrats.

Through a series of local chapter takeovers and bully campaigns to destroy the reputation of executives who refuse to submit to their will, Stern and his scandal-plagued lieutenants have consolidated low-skill service workers to create a 21st century labor empire. The ubiquitous Stern now enjoys a prominent seat at the table of every major policy discussion at the White House, including economic recovery and health care radicalization.

Obama champions the SEIU's top legislative priorities: expansive government health care (paid for with regressive sin taxes) and the "Employee Free Choice Act" to do away with private-ballot union elections in the workplace. He has SEIU-blessed bureaucrats installed in every corner of his administration to carry out the agenda.

The SEIU scored not one but two Cabinet appointees: Health and Human Services Secretary Kathleen Sebelius and Labor Secretary Hilda Solis. The SEIU pitched in with maximum donations to Solis' first congressional campaign and lent her nearly 300 canvassers and ground troops. "I wouldn't be here, were it not for my friends in the labor movement," she gushed. Indeed, over four terms in Congress, Solis has pocketed more than $900,000 in union campaign contributions.

Former SEIU chief lobbyist Patrick Gaspard served as the Obama campaign's national political director and transition deputy director of personnel. During the 2004 election cycle, he led the George Soros-funded group America Coming Together (ACT) as national field director. SEIU poured $23 million of workers' dues money into ACT in its failed attempt to put Democratic Sen. John Kerry in the White House. Under Gaspard's tenure at ACT, the get-out-the-vote group employed convicted felons as canvassers and committed campaign finance violations that led to a $775,000 fine by the Federal Election Commission. Gaspard was appointed White House political director shortly after Election Day 2008.

SEIU Secretary-Treasurer Anna Burger was appointed to the president's Economic Recovery Advisory Board to provide advice on "boosting the sagging U.S. economy" (translation: imposing new employment regulations on companies and expanding union membership rolls).

Within two weeks of moving into the White House, Obama signed a series of executive orders championed by union bosses. The new rules authorized sweeping powers for the labor secretary that essentially blackball nonunion contractors targeted by labor organizers and blacklist nonunion employees in the private sector from working on taxpayer-funded projects. Such regulatory favoritism limits freedom in the workplace and raises the cost of doing business.

Another measure immediately adopted by Obama requires that when a government service contract runs out and there's a new contract to perform the same services at the same location, the new contractor must retain the old workers. Mickey Kaus of the left-leaning Slate magazine dubbed the move the "Labor Payoff of the Day."

The payoffs keep coming. Last week Obama slashed the Labor Department's funding to investigate union corruption -- a welcome move for Stern, who has seen three of his handpicked deputies resign in 2008-2009 over financial scandals involving cronyism, nepotism and embezzlement.

California officials also reported last week that the Obama White House gave the SEIU an unprecedented role in negotiations over federal stimulus funds. According to the Los Angeles Times, the union lobbied the feds to withhold nearly $7 billion in stimulus money from California unless it revoked a wage cut for unionized health care workers -- which had already been approved by Democratic lawmakers as part of a budget deal forged in February. Top SEIU officials participated in a conference call last month on the issue; the Obama White House backs the union demands.

SEIU's enforcers have set aside $10 million to un-elect any of its political beneficiaries who abandon their pledges to do the union's legislative bidding. The campaign money was raised by slapping an extra $6-per-member fee on top of regular dues payments -- and funneled straight to the union's political action committee. Meanwhile, after spending a fortune to put Obama in office, the union laid off a third of its D.C. field staff (in violation of its own employment protections, according to the workers) due to … budget troubles.

The laid-off workers are collateral damage in Big Labor's pursuit of power. The only jobs guaranteed by SEIU's merger with Hope and Change, Inc. belong to the brass.

The National Institute of Alcohol Abuse and Alcoholism (NIAA), a part of the National Institutes of Health (NIH), will pay $2.6 million in U.S. tax dollars to train Chinese prostitutes to drink responsibly on the job.

Dr. Xiaoming Li, the researcher conducting the program, is director of the Prevention Research Center at Wayne State University School of Medicine in Detroit.

The grant, made last November, refers to prostitutes as "female sex workers"--or FSW--and their handlers as "gatekeepers."

"Previous studies in Asia and Africa and our own data from FSWs [female sex workers] in China suggest that the social norms and institutional policy within commercial sex venues as well as agents overseeing the FSWs (i.e., the 'gatekeepers', defined as persons who manage the establishments and/or sex workers) are potentially of great importance in influencing alcohol use and sexual behavior among establishment-based FSWs," says the NIH grant abstract submitted by Dr. Li.

"Therefore, in this application, we propose to develop, implement, and evaluate a venue-based alcohol use and HIV risk reduction intervention focusing on both environmental and individual factors among venue-based FSWs in China," says the abstract.

The research will take place in the southern Chinese province of Guangxi.

Guangxi is ranked third in HIV rate among Chna's provinces--and is a place where the sex business is pervasive, Li said.

“The purpose of the project is to try and develop an intervention program targeting HIV risk and alcohol use,” Li told CNSNews.com. “So basically, it’s an alcohol and HIV risk reduction intervention project."

The researcher outlined three components of the intervention program in the abstract for the project:

“(1) gatekeeper training with a focus on changing or enhancing the protective social norms and policy/practice at the establishment level; (2) FSW (female sex workers) training with a focus on the acquisition of communication skills (negotiating, limit setting) and behavioral skills (e.g., condom use skills, consistent condom use); and (3) semi-annual boosters to reinforce both social norms within establishments and individual skills,” wrote Li.

The doctor said the heart of the study involves “a community-based cluster randomized controlled trial among 100 commercial sex venues in Beihai, a costal tourist city in Guangxi.”

"We anticipate that the venue-based intervention program will be culturally appropriate, feasible, effective and sustainable in alcohol use and sexual risk reduction among FSWs," says the NIH grant abstract.

Li said his study is being done in China rather than the U.S. because prostitution occurs with alcohol use in the United States like it does in China, Americans will be able to benefit from the project’s findings.

“We want to get some understanding of the fundamental role of alcohol use and HIV risk,” he said. “We use the population in China as our targeted population to look at the basic issues. I think the findings will benefit the American people, too.”

Li said minimal research has been conducted on the link between alcohol use and prostitution as it relates to HIV.

“Alcohol has been a part of the commerce of sex for many, many years. Unfortunately, both global-wise (and) in the United States, very few researchers are looking at the complex issue of the inter play between alcohol and the commerce of sex,” he told CNSNews.com.

The grant is one of several “international initiatives” sponsored by the National Institutes of Health.

Ralph Hingson, director of epidemiology and prevention research at NIAA, told CNSNews.com, “There are many Americans who travel to China each year and they should be made aware of the HIV problem.”

Hingson said that Americans will be able to apply the studies findings to the American situation because 1.2 million Americans are currently living with HIV.

Li’s research includes exploration, development, implementation and evaluation. Currently, the project stands at the exploration stage, which the doctor expects to last 18 months.

“The first phase is kind of an exploratory study just trying to get a good understanding of the phenomena in the population of female sex workers in China. The second phase is the program development,” the professor told CNSNews.com.

Phase two will be based on the first year of the study and on “field observations,” he added. The third phase will be the implementation and evaluation of the program.

“Prostitution is illegal in China but it exists in China," Li told CNSNews.com, “but the Chinese government and the society’s attitude towards prostitution is complicated.”

According to Li, there may be as many as 10 million female prostitutes in China with the majority raging from teenagers to those in their 20s.

“We see a lot of governmental initiatives in China, like 100 percent condom distribution promotion programs, so they deliver condoms in those (prostitution) venues," he added.

“The global literature indicates an important role of alcohol use in facilitating HIV/AIDS transmission risk in commercial sex venues where elevated alcohol use/abuse and sexual risk behaviors frequently co-occur,” Li wrote when introducing the project last November.

"We expect that the intervention will improve protective normative beliefs and institutional support regarding alcohol use and HIV protection,” he added.

The NIH proposal hypothesizes that the program will decrease "problem drinking and alcohol-related sexual risk" among prostitutes that participate.

"We hypothesize that the venue-based intervention will change and enhance the protective social norms and institutional policies at the establishment level and such enhancement, accompanied by individual skill training among FSWs, will demonstrate a sustainable effect within commercial sex establishments in decreasing problem drinking and alcohol-related sexual risk, increasing consistent and correct condom use, and reducing rates of HIV/STD infection among FSWs," says the NIH abstract.

Who Wants to Confiscate Your 401(k) And IRA? Pay Close Attention America





If you’re like most people who are planning for retirement you have been socking away your money in an Individual Retirement Account (IRA) or 401(k) plan.

And when the Dow Jones Industrial Average reached 14,198.10 on Oct. 11, 2007, you thought you were set. The Dow was running up. Your retirement funds were growing. Everything looked good.

Then stocks began a downward slide that turned into a cliff dive by the following spring as the full extent of the financial crisis came to light. To make matters worse, the market then showed what it thought of the efforts of Congress and the President (both Bush and Obama) to stem the crisis—it tanked.

Fast forward to March 6, 2009. Stocks hit their lows and your retirement funds had dropped by 40 percent to 60 percent.

Now your retirement years no longer look quite so rosy. You’re thinking you may have to work an additional 10 years just to build that nest egg back to October 2007 levels.

Well, don’t fret, help is on the way. The same entity that’s done such a great job of managing Social Security may soon be managing your personal retirement plan.

Congressional Democrats have been holding hearings to decide what to do to help Americans prepare for retirement. Their conclusions: It might be a good thing for the government to eliminate tax breaks for 401(k)s, IRAs and similar retirement accounts, confiscate them and convert them to universal Guaranteed Retirement Accounts (GRA) managed by the Social Security Administration (SSA).

Now unions are joining the bandwagon. Ross Eisenbrey, vice president of the Service Employees International Union (SEIU), was quoted in a union publication saying that he supports a plan to centralize all retirement plans for American workers. His plan includes private 401(k)s and IRAs.

What he wants is for the government to confiscate your private retirement plan and set up a government pension system for everyone similar to the European system. And as is usual with grand government schemes nowadays, individual choice no longer applies.

The SEIU, by the way, is one of the nation’s largest labor unions and it invested heavily in getting President Barack Obama elected. Plus, the union is working with the left-leaning Economic Policy Institute and the National Committee to Preserve Social Security and Medicare on the plan.

In other words, the SEIU carries a lot of clout with this President and Democrat-controlled Congress.

But the SSA hasn’t done such a great job managing Social Security. According to the Congressional Budget Office, Social Security outlays will exceed revenue in 2019, and Social Security funds will be exhausted in 2049.

So, for a 20-year-old just entering the job market who will pay into the system for 40 to 45 years, there is no hope of recovering that money when he or she retires.

There is currently no bill in committee or before Congress to set up a GRA. But the fact that it’s being discussed in committees and pushed by Big Labor should be enough to frighten you.

It’s time to consider, if you haven’t already, your financial plans for your retirement years—whether you are 20, 70 or somewhere in between. Is it time to cash it out? That’s for you to decide along with a tax or financial advisor, as the penalties for early withdrawal are oppressive.

Regardless, as the Federal Reserve prints dollar upon dollar to fund its economic stimulus Ponzi schemes, gold as an investment looks better and better.

Intelligence Report: Pelosi Briefed On Use of Interrogation Tactics In Sept. ’02



ABC News’ Rick Klein reports: House Speaker Nancy Pelosi was briefed on the use of “enhanced interrogation techniques” on terrorist suspect Abu Zubaydah in September 2002, according to a report prepared by the Director of National Intelligence’s office and obtained by ABC News.

The report, submitted to the Senate Intelligence Committee and other Capitol Hill officials Wednesday, appears to contradict Pelosi’s statement last month that she was never told about the use of waterboarding or other special interrogation tactics. Instead, she has said, she was told only that the Bush administration had legal opinions that would have supported the use of such techniques.

The report details a Sept. 4, 2002 meeting between intelligence officials and Pelosi, then-House intelligence committee chairman Porter Goss, and two aides. At the time, Pelosi was the top Democrat on the House intelligence committee.

The meeting is described as a “Briefing on EITs including use of EITs on Abu Zubaydah, background on authorities, and a description of particular EITs that had been employed.”

EITs stand for “enhanced interrogation techniques,” a classification of special interrogation tactics that includes waterboarding.

Pelosi, D-Calif., sharply disputed suggestions last month that she had been told about waterboarding having taken place.

“In that or any other briefing . . . we were not, and I repeat, were not told that waterboarding or any of these other enhanced interrogation techniques were used," Pelosi said at a news conference in April. "What they did tell us is that they had some legislative counsel . . . opinions that they could be used, but not that they would."

Brendan Daly, a Pelosi spokesman, said Pelosi’s recollection of the meeting is different than the way it is described in the report from the DNI’s office.

“The briefers described these techniques, said they were legal, but said that waterboarding had not yet been used,” Daly said.

Daly pointed out that the report backs up Pelosi’s contention that she was briefed only once on “enhanced interrogation techniques.” Her name does not appear elsewhere in the report.

"As this document shows, the speaker was briefed only once, in September 2002," Daly said.

At the briefing, Pelosi did not formally register objections to the interrogation techniques authorized by the Bush administration. President Obama has said he considers such techniques to be "torture."

According to the interrogation memos released last month by the Obama administration, Abu Zubaydah was waterboarded 83 times in August 2002.

UPDATE: The report also details dozens of other meetings with members of Congress -- though not with Pelosi present -- where the use of waterboarding and other interrogation techniques was described.

The Senate intelligence committee’s chairman and ranking member, Bob Graham and Richard Shelby, were given a briefing similar to the one with Pelosi and Goss on Sept. 27, 2002, according to the report.

On Feb. 4, 2003, a briefing on “enhanced interrogation techniques” for Sen. Pat Roberts, R-Kan., and Sen. John D. Rockefeller IV, D-W.Va., revealed that interrogations of Abu Zubaydah and Abd Al-Rahim Al-Nashiri were taped.

In addition, that briefing “described in considerable details” the techniques used, including “how the water board was used.”

A similar briefing the following day included Goss and Rep. Jane Harman, D-Calif., who by that time had become the top Democrat on the House intelligence committee, when Pelosi moved on to become minority leader.

The report is accompanied by a letter from CIA Director Leon Panetta to intelligence committee leaders that describes the way it was compiled: “This letter presents the most thorough information we have on dates, locations, and names of all Members of Congress who were briefed by the CIA on enhanced interrogation techniques. Glenn Beck Throws ACORN Spokesman Out Of Studio

ACORN National Spokesman Scott Levenson was ejected from a Fox News studio Wednesday following an off-camera altercation with host Glenn Beck that involved racially charged comments, as they were described by Beck.

“I threw him out of the studio, get the hell out of my studio,” Beck told viewers he said after Levenson accused him of being “afraid of black people.”

Beck told listeners after the break that Levenson was expelled from the studio after he accused the host of being racist. Levenson appeared on the “Glenn Beck” show to respond to criminal charges filed against ACORN employees in Nevada on Monday. The non-profit organization, formally known as the Association for Community Organizations for Reform Now, is under investigation nationwide for voter fraud in at least 12 different states.

In his exchange with Beck, the ACORN spokesman insisted that individual employees were responsible for the violations but not the national organization. Beck was not persuaded by this defense and persisted in his questioning.

Beck described the off-camera altercation to viewers and asked off-camera assistants to verify what was said during the break. This description to television viewers is as follows.

Who thinks that he told me…That I, what was it I thought that he said that I hate black people. How many here thought that he said that, as soon as the cameras went off…you thought… I was afraid of black people. That’s actually what he said to me…let’s just take it...because actually better than just I hate black people.

I’m standing here and he gets up and I say you sir, you and your organization are bad for America. And says, I’ll use yours...you’re just afraid of black people. I threw him out of the studio – get the hell out of my studio.

And then he went off... he went off.

ACORN did release a statement on the criminal indictments in Nevada that was critical of state officials.

This recent attack by the Nevada Secretary of State and Attorney General is the latest in an ongoing assault designed to blame the victim and prioritize media grandstanding above the pursuit of justice.

From the time ACORN first suspected that some of its employees had tried to defraud ACORN by turning in bogus forms, ACORN repeatedly called its suspicions to the attention of election officials and requested that they investigate immediately.

Our policy all along has been to pay workers at an hourly rate and to not pay employees based on any bonus or incentive program. When it was discovered that an employee was offering bonuses linked to superior performance, that employee was ordered to stop immediately.

It is unfortunate that the Secretary of State can't distinguish the victim from the villain.

Obama Tries to Stop Union Disclosure

Fifty years ago, Congress passed the landmark Landrum-Griffin Act to protect rank-and-file union members from malfeasance by union leaders. Senate hearings had uncovered serious corruption and other unethical practices inside the labor movement, and a bipartisan coalition emerged to shine the light of disclosure on union practices.

Nevertheless, Democrats in Congress and in the executive branch have often attempted to undercut that law's financial reporting and disclosure requirements. Prior to reforms adopted in the George W. Bush administration, for example, one union could get away with reporting a $62 million expenditure as nothing more than "contributions, gifts, and grants to local affiliates" -- with no further explanation. Unfortunately, the Obama administration is already showing that it wants to return to this nontransparent standard of financial disclosure.

Within days of the inauguration, the new leadership at the Labor Department moved to delay implementing a regulation finalized in January that would have shed much needed light on how union managers compensate themselves with union dues. The regulation required disclosure of receipts for expenditures and for the purchase and sale of union assets -- disclosures that would help deter embezzlement. The administration has since moved even more aggressively, initiating proceedings to rescind this rule and others promulgated when I was secretary of labor.

The Labor Department's Office of Labor Management Standards (OLMS), created to enforce the 1959 law, also recently announced that it would not enforce compliance with the conflict-of-interest disclosure form (the "LM-30" form) that was revised in 2007. Labor's Web site states that "it would not be a good use of resources."

Instead, union managers will be able to file decades-old, less enlightening disclosure forms while the department considers whether to "revise" (i.e., gut) the current disclosure requirements. But what could be a better use of department resources than enforcing the laws under its jurisdiction?

From 2001-2008, the Labor Department secured more than 1,000 union fraud-related indictments and 929 convictions. This enforcement record was accomplished even though the enforcement office accounts for less than 0.1% of the department's budget. OLMS is the lone federal agency with the job of protecting worker interests in how their unions are managed. The last Congress increased President Bush's budget request for the Labor Department by $956 million even as it targeted OLMS for a budget cut.

This repeats the pattern we saw during the last Democratic administration. Under President Bill Clinton, staffing decreased more than 40%. The number of compliance audits dropped no less than 75% from fiscal year 1992 to fiscal year 2000. I would expect the current Congress to once again slash the OLMS budget, with the administration's blessing.

Union membership peaked in the 1950s, when more than one-third of American workers belonged to a union. Today, just 7.6% of American private-sector workers belong to a union. A Rasmussen Research survey conducted in March found that 81% of nonunion members do not want to belong to a union.

The response by union leaders and their Democratic allies to declining union membership is the Employee Free Choice Act. To increase unionization, it would deprive workers of private balloting in organizing elections, and it would substitute a signature-card process that would expose workers to coercion. The bill would also deny workers the right to ratify, or not ratify, labor contracts drafted by government arbitrators when negotiations in newly unionized workplaces exceed the bill's rigid timetable.

The Obama administration likes to say that it is "pro-worker." But something is amiss when its labor priorities are forcing unionization and labor contracts on American workplaces, and denying union members information on how their dues money is spent.

Ms. Chao was secretary of labor from 2001 to 2009 and is now a fellow at the Heritage Foundation.

Last Friday, the day after Chrysler filed for bankruptcy, I drove past the company’s headquarters on Interstate 75 in Auburn Hills, Mich.

As I glanced at the pentagram logo I felt myself tearing up a little bit. Anyone who grew up in the Detroit area, as I did, can’t help but be sad to see a once great company fail.

But my sadness turned to anger later when I heard what bankruptcy lawyer Tom Lauria said on a WJR talk show that morning. “One of my clients,” Lauria told host Frank Beckmann, “was directly threatened by the White House and in essence compelled to withdraw its opposition to the deal under threat that the full force of the White House press corps would destroy its reputation if it continued to fight.”

Lauria represented one of the bondholder firms, Perella Weinberg, which initially rejected the Obama deal that would give the bondholders about 33 cents on the dollar for their secured debts while giving the United Auto Workers retirees about 50 cents on the dollar for their unsecured debts.

ACORN Got $53 Million In Federal Funds Since 94, Now Eligible For Up To $8 Billion More

At least $53 million in federal funds have gone to ACORN activists since 1994, and the controversial group could get up to $8.5 billion more tax dollars despite being under investigation for voter registration fraud in a dozen states.

The economic stimulus bill enacted in February contains $3 billion that the non-profit activist group known more formally as the Association for Community Organizations for Reform Now could receive, and 2010 federal budget contains another $5.5 billion that could also find its way into the group’s coffers.

An Examiner review of federal spending data found that ACORN has received at least $53 million in federal money since 1994. A downloadable spreadsheet of the $53 million is posted on washingtonexaminer.com.

Scott Levenson, ACORN's national spokesman, said "we have received no significant federal funding." When asked by The Examiner about the $53 million, Levenson said: "If you listen to some of the Republicans who are going to get a billion dollars from the stimulus package, I'm still waiting for my share. Their claims are overinflated, this is a gimmick and an attempt to demonize ACORN."

At least one lawmaker, Rep. Michelle Bachmann, R-MN, wants to stop the flow of tax dollars to ACORN, but House Financial Services Committee Chairman Barney Frank, D-MA, stands in her way.

Frank plans to strip out an anti-ACORN provision Bachman succeeded in inserting in the proposed Mortgage Reform and Anti-Predatory Lending Act that could be voted on by the House today or Thursday.

Bahmann’s amendment was unanimously approved by Frank’s committee in a voice vote last week. It would block organizations that have been indicted for voter registration or vote fraud from receiving housing counseling grants and legal assistance grants.

The Bachman prohibition would apply only to the proposed mortgage reform legislation, and would not change ACORN’s ability to receive funds under either the stimulus program or 2010 budget.

Frank said his panel’s approval of the Bachman amendment was a mistake and that he had not carefully reviewed its language when he previously voted yes.

“I did not read it carefully, and it was in the last minute that the amendment was accepted,” Frank said. “It is a deeply flawed amendment and I am opposed to it. Banning people from possible participation in government programs based on an indictment is a violation of the basic principles of due process.”

Frank plans to offer another amendment to the bill on the House floor that would allow non-profits that have been indicted to receive grants under the legislation so long as they have not been convicted.

Bachmann said Frank’s amendment would “eviscerate the meaning” of her original amendment.

“I am disturbed by how cavalierly Washington spends the taxpayers’ money,” Bachmann told The Examiner. “The new charges brought against ACORN this week in Nevada reaffirm my concern about giving taxpayer dollars to organizations that are repeatedly under criminal indictment. Last week, I asked: Whose side are we on, the taxpayer's or ACORN's?”

Non-profit groups like ACORN can apply for $2 billion in funds set aside for the redevelopment of abandoned and foreclosed homes under the $800 billion economic stimulus bill passed earlier this year.

An additional $1 billion in Community Development Block Grants (CDBG) are included in the stimulus bill. ACORN and other non-profit advocacy groups could receive through federally funded housing programs administered by state and local governments.

“ACORN is not normally eligible to apply directly for CDBG funds but may apply to the states and local government units that are CDBG recipients,” Matthew Vadum, a senior analyst and editor with Capital Research Center (CRC), said. “This opens the way for ACORN to receive billions more in taxpayer money.”

In addition to the $3 billion available in the stimulus package, the proposed $47.5 billion Department of Housing and Urban Development (HUD) budget provides $1 billion for an affordable housing trust fund and $4.5 billion in CDBG funds that could be funneled to ACORN indirectly.

“This means $8.5 billion is on the table this year for ACORN and other left-wing advocacy groups,” Vadum said. “ACORN won’t get all of the money but any tax dollars going to a criminal enterprise like this is just wrong.”

Sen. Christopher Dodd is pushing ahead with a call for prosecuting Bush administration officials over the use of waterboarding terrorist detainees.

The Connecticut Democrat told home-state bloggers over the weekend that the Obama administration's release of memos detailing interrogation techniques used on detainees creates a "moral imperative" for a congressional investigation — or a criminal probe that could involve former Vice President Dick Cheney's staff, Politico.com reported.

When asked if a probe should go "as high as Cheney's office," Dodd replied: "You gotta go where you gotta go."

Dodd cited his father's experience as a prosecutor at the Nuremberg war crimes trials. Attorney Thomas Joseph Dodd, who was later elected to the Senate, held a leading position on the Allied prosecution team in 1945 and 1946.

Referring to the Nazi defendants, Dodd said "even these thugs got a lawyer; even these thugs got a trial."

He added: "In a sense, not to prosecute people or pursue them when these acts have occurred is . . . to invite it again in some future administration."

The New York Times reported on Tuesday that an internal Justice Department inquiry had found that Bush administration lawyers who authorized harsh interrogations committed no crimes warranting prosecution.

Proposal 'comes close to making it federal offense to log onto Internet'

A new proposal in Congress is threatening fines and jail time for what it calls "cyberbullying" – communications that include e-mails and text messages that "cause substantial emotional distress."

The vague generalities are included in H.R. 1966 by California Democrat Linda Sanchez and about a dozen co-sponsors.

But it already is being condemned as unconstitutional, unrealistic and probably ineffectual.

At Wired.com, in a report labeled "Threat Level," writer David Kravets criticized the plan to demand "up to two years in prison for those whose electronic speech is meant to 'coerce, intimidate, harass, or cause substantial emotional distress.'"

"Instead of prison, perhaps we should say gulag," he wrote.

Such limits never would pass First Amendment muster, "unless the U.S. Constitution was altered without us knowing," he wrote. "So Sanchez, and the 14 other lawmakers who signed on to the proposal are grandstanding to show the public they care about children and are opposed to cyberbullying."

The plan is labeled the Megan Meier Cyberbullying Prevention Act, after the 13-year-old Meier, whose suicide last year reportedly was prompted by a woman who utilized the MySpace social networking site to send the teen critical messages.

The defendant in the case, Lori Drew, was accused under the Computer Fraud and Abuse Act.

"Sanchez's bill goes way beyond cyberbullying and comes close to making it a federal offense to log onto the Internet or use the telephone," Kravets wrote. "The methods of communication where hostile speech is banned include e-mail, instant messaging, blogs, websites, telephones and text messages."

"We can't say what we think of Sanchez's proposal," he said. "Doing so would clearly get us two years in solitary confinement."

Wrote a contributor to the Wired forum page, "If passed, this legislation could be easily abused with the effect of criminalizing all criticism. You probably [couldn't] even criticize the legislation itself because it would cause Sen. Sanchez emotional distress or possibly be considered a form of intimidation."

The bill, which has been referred to the House Committee on the Judiciary, states, "Whoever transmits in interstate or foreign commerce any communication, with the intent to coerce, intimidate, harass, or cause substantial emotional distress to a person, using electronic means to support severe, repeated, and hostile behavior, shall be fined under this title or imprisoned not more than two years, or both."

It states: "Cyberbullying can cause psychological harm, including depression; negatively impact academic performance
, safety, and the well-being of children in school; force children to change schools; and in some cases lead to extreme violent behavior, including murder and suicide."

Glossy Internet Magazine Targets Americans for Jihad Training

It's been likened to Al Qaeda's "Vanity Fair," a new English-language Internet magazine called "Jihad Recollections" that focuses on the terrorist group, its founder, Usama Bin Laden, and how to commit jihad. It also predicts the demise of the United States.

“This is designed for Americans,” says noted terrorism expert Steven Emerson, founder of the Investigative Project on Terrorism in Washington, D.C., and author of the book "American Jihad: The Terrorists Living Among Us."

“It’s not for Brits, not for Germans, not for jihadists in the Middle East. It’s designed for Americans and it’s designed to get them to convert to Islam or to carry out jihad acts of terror,” he said.

“What started off as some angry kids in their basement has transformed over the past several years into a robust Al Qaeda propaganda outlet right here in our backyard,” says Jarret Brachman, an Al Qaeda specialist and author of the new book, “Global Jihadism.”

Brachman says “it raises the bar for pro-Al Qaeda propaganda in English. Its presentation is flashier than any English language Al Qaeda propaganda that we’ve seen to date.” He also says “the publication shows how deeply embedded in the global Al Qaeda movement its editors are.”

It is not clear what connection, if any, the magazine has to Al Qaeda or its followers. It is published by the “Al Fursan Media Foundation,” but FOX News could not find such an organization or a way to contact them for comment.

Yet “Jihad Recollections” certainly highlights the terrorist group and the goals of Islamic jihad in a sophisticated and graphically slick presentation similar to any high quality Web site.

The magazine includes the speeches and writings of Bin Laden and his deputy, Ayman al-Zawahiri. Articles range from “Four Practical Steps to Expand the Global Jihad,” to “The Science Behind Night Vision Technology” and “Principles of Guerrilla Warfare.”

“The magazine is quite startling,” said Emerson. It is “a veritable manual on how to carry out terrorism. It’s quite shocking, and the question is whether it violates the law or not.”

The first issue says of the 9/11 attacks, that “the strategy was genius.” It calls America “one of the most atrocious and egotistical regimes to date,” and it accuses the United States of spreading corruption in Islamic countries through its embassies. “How can we expect from America any good?” it asks. “We only expect from it every evil and corruption.”

“Jihad Recollections” appears to prepare followers to engage in jihad. One section teaches aspiring jihadists how to stay in shape by doing exercise without weights. Articles with photographs of men dressed in white robes with their faces covered encourage them to exercise at home and stay away from American gyms because “they are full of music, semi-naked women, free mixing.” It warns of the dangers of “showing off” during a workout and even observes that protein shakes are too expensive and not worth the money.

For those who thought the election of Barack Obama as president would assuage the militant world, the magazine makes it quite clear that is not the case.

“To the Muslims who voted for Obama and were optimistic that he would make a positive change ... nothing will change except things can only get worse,” the magazine proclaims. “Only Allah knows how much worse it will get.”

The magazine criticizes the Obama economic stimulus plan, calling it “flawed,” and ridicules the president as “Mr. Yes We Can,” whose policies will “continue to loot all the hardworking Americans wealth.”

It even includes the views of some prominent critics of the president’s polices, such as former New York Lt. Gov. Betsy McCaughey, now an adjunct fellow at the Hudson Institute, and veteran Tennessee Rep. Zach Wamp, the ranking Republican on the House Military Construction and Veterans Affairs Subcommittee. Such references clearly indicate an awareness of American political discourse similar to the nation’s political policy magazines.

In fact, “Jihad Recollections” proclaims: “It is the first of its kind as it is geared towards the English speaking Muslims who are interested in gaining heights in their religious, political, economical, social, technological, strategic, historical, biographical and health awareness.”

The writing may be a bit flamboyant, and while it boasts that “The U.S. grows weaker every day,” there is no explicit call for violence against the country or against Americans. Emerson thinks the publication is “pushing the envelope of the First Amendment” by reporting on jihad issues, and he says it indicates that the Internet is being used as “one of the major sources for radicalization.”

“Thousands of people have accessed these pro-Al Qaeda websites,” notes Brachman. He says “this new journal is receiving more and more praise from within the English-language jihadist movement. The fact is that their movement is growing — their popularity is growing.”

More than 5,000 people have viewed “Jihad Recollections” and 11 people list it as one of their “favorites.” Who are its readers? And do they adhere to the jihad philosophy?

Whoever is behind “Jihad Recollections” has a strange mix of opinion with one focus: seemingly to spread the message of Islamic jihad at the expense of Americans. That such a publication is accessible at all speaks to the freedoms we enjoy in our country while, experts say, also serving as a warning of the danger that Islamic militants and radicals pose to our nation.
